While it is uncommon, it is not unheard of that termites are found after a clear building and pest inspection.  This can happen for many reasons including natural occurrence, infested neighboring properties, negligent inspectors and buyers failing to do their due diligence. The most common way that people fail to do their due diligence is by not getting a pre-purchase building and pest inspection. Terminating Under A 'Pest and Building' Condition - "The Buyer Must Act Reasonably"

GUEST BLOG BY MAP LAWYERS In Queensland it is standard for contracts of sale to include a pest and building condition. As you can imagine, these options are not always possible due to safety concerns and budgeting restraints. The purchase of a property is likely to be the biggest investment someone will ever make in their lifetime. As such, many buyers want to be assured that the property they are considering purchasing is in good condition, including the roof. Drone inspections can provide peace of mind by capturing 4k High-Definition footage of the current condition of a rooftop. The Drone Inspection Process If you’re considering getting a drone inspection for your roof, be assured that the process is stra...

To speed up the buying process, some sellers are getting a pre-sale building and pest inspection report to show potential buyers. By the same token, many real estate agents are pushing buyers to put in an offer without it being subject to a building and pest inspection. Whilst other buyers are ignoring unfavourable building and pest reports to get into the market while they can. All of this results in a pressure cooker environment for buyers. Decisions need to be made quickly and they don’t want to miss out on a property by moving too slowly. Leading many buyers to ask if they can use someone else’s building and pest report thinking this will save them time and money. In the heat of the moment, it may seem convenient to rely on the seller’s report and put in an offer that isn’t subject to building and pest. Whilst this may seem like a good idea at the time,...
